These Auction Terms & Conditions of Sale govern participation in auctions conducted by Salem Art House, LLC (“Salem Art House,” “we,” “us,” or “our”). By registering for an auction, placing a bid, or purchasing property — whether online, in person, by telephone, by absentee bid, or through another authorized method — you agree to be bound by these Terms and any additional terms stated for the particular auction. Please read these Terms before bidding.
Salem Art House conducts auctions of fine art, antiques, decorative arts, furnishings, jewelry, collectibles, estate property, historical objects, and other personal property. Property may be owned by third-party consignors, estates, Salem Art House, related parties, or other disclosed owners. Each lot constitutes a separate sale.
Unless expressly stated otherwise in writing, all property is offered and sold AS IS, WHERE IS, WITH ALL FAULTS. All sales are final except where otherwise expressly provided or required by law.
Salem Art House and the consignor make no representation or warranty, express or implied, regarding merchantability, fitness for a particular purpose, condition, age, date, authorship, artist or maker, attribution, authenticity, provenance, origin, period, materials, dimensions, completeness, rarity, restoration, repair, or any other characteristic. Measurements, weights, dates, and descriptions are approximate unless expressly stated otherwise.
Catalog descriptions represent opinions or information available at the time of cataloging, and may be based on visual examination, information from consignors or previous owners, labels, inscriptions, receipts, publications, databases, comparable objects, or third-party research. We do not warrant that such information is complete or independently verified. Unless expressly warranted in writing, provenance information is provided for informational purposes and is not guaranteed.
Property offered at auction is frequently antique, vintage, previously owned, restored, altered, or affected by age and use. The absence of a condition statement does not imply that a lot is free from defects, wear, restoration, alteration, or damage. Condition reports and additional photographs are provided as a convenience — they are opinions only and are not warranties. Bidders are responsible for determining whether the condition of a lot is acceptable before bidding.
Photographs are intended to assist bidders but may not accurately reproduce color, scale, texture, or condition. Display stands, jewelry forms, trays, boxes, easels, props, and other display materials are not included with a lot unless specifically stated.
Salem Art House may require bidders to register and provide identification, contact information, payment information, references, or deposits before bidding, and reserves the right to approve, refuse, suspend, or revoke bidding privileges. Bidders are responsible for maintaining the security of their accounts and for bids placed through their registered account.
A bid constitutes an offer to purchase the applicable lot subject to these Terms. Bids may be accepted through methods authorized for the particular auction, including online, live, absentee, or telephone bidding. Salem Art House is not responsible for a bidder’s failure to place or transmit a bid successfully.
Unless expressly stated otherwise, all lots are offered with reserve — the confidential minimum price at which a consignor has authorized a lot to be sold. Salem Art House may withdraw a lot at any time before completion of the sale as permitted by law. If a reserve is not met, the lot may be passed and handled in accordance with the consignor’s agreement.
A sale is complete when the auctioneer announces completion by the fall of the hammer or another customary method. For online or timed auctions, completion may be indicated by the platform’s closing of the lot. The highest accepted bidder at completion becomes the Buyer, subject to these Terms.
To the extent permitted by law, Salem Art House may resolve disputes concerning bids, increments, lot closings, bidder identity, technical or clerical errors, or other irregularities — including reopening bidding, rejecting a bid, or canceling a transaction affected by material error. Our determination shall be final to the fullest extent permitted by law.
Online bidding may be provided through third-party technology. Salem Art House does not guarantee uninterrupted or error-free operation of any website, platform, connection, or software, and is not responsible for bids delayed, lost, duplicated, or not received because of technical problems outside its reasonable control.
A buyer’s premium will be added to the Hammer Price at the rate stated in the applicable auction listing or auction-specific terms. The premium may vary by auction, bidding method, or platform. Bidders should review the applicable premium before bidding.
The total amount owed by the Buyer (“Purchase Price”) may include:
Payment is due within the period stated in the auction-specific terms or invoice. Accepted methods may vary. Salem Art House may require wire transfer, certified funds, or another specified method for high-value transactions, and may require cleared funds before releasing property. No Buyer may transfer a purchase or invoice to another person without written approval.
Buyers are responsible for applicable sales, use, excise, or other taxes unless a valid exemption applies and appropriate documentation is provided.
Title and risk of loss pass to the Buyer at the time specified by law and these Terms. Salem Art House may retain possession of purchased property until all amounts due have been paid in cleared funds.
Pickup location, dates, hours, and deadlines will be stated in the applicable auction information, invoice, or other instructions. Do not assume every purchase will be picked up at our downtown location — property may be at Salem Art House, an estate, or another designated point. Buyers are responsible for confirming the correct location before traveling.
Unless expressly stated otherwise, the Buyer is responsible for arranging and paying all packing, shipping, insurance, and transportation. Availability varies by property and auction. Salem Art House may refer Buyers to third-party shippers as a convenience; those shippers are independent and are not agents of Salem Art House.
Buyers must remove purchases within the deadline stated for the applicable auction. Property not removed by the deadline may be subject to reasonable storage, handling, or related charges. If property remains unclaimed, Salem Art House may provide notice and exercise remedies available under these Terms and applicable law.
If a Buyer fails to pay amounts due, Salem Art House may exercise any remedies permitted by law, including, where appropriate:
Salem Art House reserves the right to withdraw property before completion of the sale as permitted by applicable law.
Salem Art House does not ordinarily sell modern firearms. From time to time an auction may include antique, historical, or permanently inoperable arms offered primarily as collectible or historical objects, subject to applicable federal, state, and local law. Salem Art House may require additional documentation, specialist review, or transfer through an appropriately licensed third party.
Salem Art House may establish policies governing participation by employees, contractors, consignors, or related parties. No person may bid on behalf of Salem Art House or a seller except as permitted by law and properly disclosed where required.
If Salem Art House is unable to deliver purchased property because of loss, theft, damage, casualty, title dispute, or another circumstance beyond its reasonable control, it may cancel the sale and refund amounts actually paid for that lot. Such refund shall constitute the Buyer’s sole monetary remedy for nondelivery, to the fullest extent permitted by law.
To the fullest extent permitted by law, Salem Art House shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from participation in an auction or purchase of property. Nothing in these Terms excludes liability that cannot lawfully be excluded.
Individual auctions may have additional or different terms concerning buyer’s premium, payment, pickup, shipping, bidding procedures, reserves, restricted property, or sale location. Auction-specific terms supplement these Terms and, where they expressly conflict, govern for that auction to the extent of the conflict.
Salem Art House may revise these Terms from time to time. The Terms applicable to a particular auction are those made available to bidders for that auction.
These Terms and transactions with Salem Art House shall be governed by the laws of the State of Oregon, without regard to conflict-of-law principles. To the extent permitted by law, venue for disputes shall lie in Marion County, Oregon.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.
